Lucknow. There is a boom of Makar Sankranti across the country. People start flying kites 5-6 days before this festival. People fly kites on Makar Sankranti in the morning and evening in all the cities of the state including the capital Lucknow. But do you know that flying a kite without permission is also a crime. You can also be fined for this. According to the law, you have to get a license to fly a kite. It is mentioned in the Aircraft Act 1934-2 (1). Under this act, it is necessary to have a license to manufacture, repair, fly all the items to be flown, including kites, balloons. Failure to do so is a provision of 10 lakh and a two-year jail sentence and both. However, last year the government has amended the act. Under the amendment, a penalty of up to one crore has been provided in the crime related to carrying explosives etc. in aircraft, but no changes have been made in the rules related to flying kites.
The Aircraft Act 1934 2 (1) states that an aircraft means any machine which can receive support by reaction of air from atmosphere. Balloons, whether stationary or unstable airships, kites, gliders and flying machines are covered under this. This law is equally applicable to all individuals and all over the country. Under this, being caught flying a kite without a license can lead to a fine of up to 10 lakh and imprisonment for two years.
In this connection, the Indian ThinkTank Center for Civil Society has organized five law colleges in the country (Maharashtra National Law College, MNLU Mumbai, Symbiosis Law School – Noida, Hidayatullah National Law University – Raipur, National Law School of India University – Bangalore and The National Academy of Students of Legal Studies and Research-Hyderabad) have written to Civil Aviation Minister Ashok Gajapathi Raju and DGCA to provide license related to kite flying.
